The Ministry of Science and Technology has just issued a Circular stipulating criteria for investment projects in high-tech research and development facilities and high-tech application projects to manufacture products in high-tech zones...<\/strong><\/p><\/p>\n\n\n

Circular 08\/2024\/TT-BKHCN includes two sets of criteria including: investment projects in high-tech research and development facilities; investment projects applying high technology to produce high-tech products.<\/p><\/p>\n\n\n\n

For investment projects in high-tech research and development facilities, it is necessary to meet the provisions of Articles 28 and 29 of Decree No. 10\/2024\/ND-CP dated February 1, 2024 of the Government on high-tech zones, with four main criteria:<\/p><\/p>\n\n\n\n

M\u1ed9t<\/em><\/strong> l\u00e0<\/em><\/strong>, \u00edt nh\u1ea5t 70% t\u1ed5ng s\u1ed1 lao \u0111\u1ed9ng c\u1ee7a d\u1ef1 \u00e1n ph\u1ea3i c\u00f3 h\u1ee3p \u0111\u1ed3ng lao \u0111\u1ed9ng kh\u00f4ng x\u00e1c \u0111\u1ecbnh th\u1eddi h\u1ea1n ho\u1eb7c h\u1ee3p \u0111\u1ed3ng lao \u0111\u1ed9ng c\u00f3 th\u1eddi h\u1ea1n t\u1eeb m\u1ed9t n\u0103m tr\u1edf l\u00ean \u0111\u1ec3 tham gia tr\u1ef1c ti\u1ebfp v\u00e0o ho\u1ea1t \u0111\u1ed9ng nghi\u00ean c\u1ee9u v\u00e0 ph\u00e1t tri\u1ec3n. Trong \u0111\u00f3, \u00edt nh\u1ea5t 85% lao \u0111\u1ed9ng ph\u1ea3i c\u00f3 tr\u00ecnh \u0111\u1ed9 \u0111\u1ea1i h\u1ecdc tr\u1edf l\u00ean.<\/p><\/p>\n\n\n\n

Hai<\/em><\/strong> l\u00e0<\/em><\/strong>, m\u1ed7i l\u0129nh v\u1ef1c nghi\u00ean c\u1ee9u v\u00e0 ph\u00e1t tri\u1ec3n ch\u00ednh trong d\u1ef1 \u00e1n ph\u1ea3i c\u00f3 \u00edt nh\u1ea5t m\u1ed9t th\u00e0nh vi\u00ean c\u00f3 \u00edt nh\u1ea5t 5 n\u0103m kinh nghi\u1ec7m trong l\u0129nh v\u1ef1c \u0111\u00f3.<\/p><\/p>\n\n\n\n

Third, the total annual expenditure on research and development activities must reach at least 80% of the total operating costs of the project.<\/p><\/p>\n\n\n\n

Fourth, the project must have adequate machinery and equipment for research and development, suitable for the research and development field of the project, and arranged in a working space that ensures labor safety standards according to the provisions of Vietnamese law.<\/p><\/p>\n\n\n\n

For investment projects applying high technology to produce high-tech products, it is necessary to meet the requirements of Decree No. 10\/2024\/ND-CP with the following five criteria:<\/p><\/p>\n\n\n\n

First, high-tech products must be on the list of high-tech products encouraged for development, and the revenue ratio from the production of high-tech products must reach at least 80% of the total annual revenue of the project.<\/p><\/p>\n\n\n\n

Second, at least 75% of the project's workers must have a diploma, vocational education certificate or university degree.<\/p><\/p>\n\n\n\n

Third, projects with capital scale of VND 6,000 billion or more and at least 3,000 employees, the rate of employees participating in research, development and technology application must reach at least 2.5% of the total number of employees; for the remaining projects, this rate must reach at least 5%.<\/p><\/p>\n\n\n\n

B\u1ed1n<\/em><\/strong> l\u00e0<\/em><\/strong>,<\/em> t\u1ef7 l\u1ec7 chi cho nghi\u00ean c\u1ee9u, ph\u00e1t tri\u1ec3n v\u00e0 \u1ee9ng d\u1ee5ng c\u00f4ng ngh\u1ec7 h\u1eb1ng n\u0103m ph\u1ea3i \u0111\u1ea1t \u00edt nh\u1ea5t 0,5% t\u1ed5ng doanh thu \u0111\u1ed1i v\u1edbi c\u00e1c d\u1ef1 \u00e1n c\u00f3 v\u1ed1n t\u1eeb 6.000 t\u1ef7 \u0111\u1ed3ng tr\u1edf l\u00ean ho\u1eb7c doanh thu t\u1ed1i thi\u1ec3u 10.000 t\u1ef7 \u0111\u1ed3ng m\u1ed7i n\u0103m trong ba n\u0103m. \u0110\u1ed1i v\u1edbi c\u00e1c d\u1ef1 \u00e1n kh\u00e1c, t\u1ef7 l\u1ec7 n\u00e0y ph\u1ea3i \u0111\u1ea1t \u00edt nh\u1ea5t 1%.<\/p><\/p>\n\n\n\n

Fiveth, the project must invest in a synchronous, advanced technological line, with at least 1\/3 of the equipment automatically controlled by a program and meeting occupational safety and hygiene standards as prescribed by Vietnamese law.<\/p><\/p>\n\n\n\n

Circular 08\/2024\/TT-BKHCN will take effect from December 23, 2024, opening up new opportunities and challenges in developing high-tech projects in high-tech zones in Vietnam, while improving the quality of research and production in this field.<\/p><\/p>\n\n\n\n
