The Ministry of Science and Technology has just issued a Circular stipulating criteria for investment projects in high-tech research and development facilities and high-tech application projects to manufacture products in high-tech zones...
Circular 08/2024/TT-BKHCN includes two sets of criteria including: investment projects in high-tech research and development facilities; investment projects applying high technology to produce high-tech products.
For investment projects in high-tech research and development facilities, it is necessary to meet the provisions of Articles 28 and 29 of Decree No. 10/2024/ND-CP dated February 1, 2024 of the Government on high-tech zones, with four main criteria:
Một là, ít nhất 70% tổng số lao động của dự án phải có hợp đồng lao động không xác định thời hạn hoặc hợp đồng lao động có thời hạn từ một năm trở lên để tham gia trực tiếp vào hoạt động nghiên cứu và phát triển. Trong đó, ít nhất 85% lao động phải có trình độ đại học trở lên.
Hai là, mỗi lĩnh vực nghiên cứu và phát triển chính trong dự án phải có ít nhất một thành viên có ít nhất 5 năm kinh nghiệm trong lĩnh vực đó.
Third, the total annual expenditure on research and development activities must reach at least 80% of the total operating costs of the project.
Fourth, the project must have adequate machinery and equipment for research and development, suitable for the research and development field of the project, and arranged in a working space that ensures labor safety standards according to the provisions of Vietnamese law.
For investment projects applying high technology to produce high-tech products, it is necessary to meet the requirements of Decree No. 10/2024/ND-CP with the following five criteria:
First, high-tech products must be on the list of high-tech products encouraged for development, and the revenue ratio from the production of high-tech products must reach at least 80% of the total annual revenue of the project.
Second, at least 75% of the project's workers must have a diploma, vocational education certificate or university degree.
Third, projects with capital scale of VND 6,000 billion or more and at least 3,000 employees, the rate of employees participating in research, development and technology application must reach at least 2.5% of the total number of employees; for the remaining projects, this rate must reach at least 5%.
Bốn là, tỷ lệ chi cho nghiên cứu, phát triển và ứng dụng công nghệ hằng năm phải đạt ít nhất 0,5% tổng doanh thu đối với các dự án có vốn từ 6.000 tỷ đồng trở lên hoặc doanh thu tối thiểu 10.000 tỷ đồng mỗi năm trong ba năm. Đối với các dự án khác, tỷ lệ này phải đạt ít nhất 1%.
Fiveth, the project must invest in a synchronous, advanced technological line, with at least 1/3 of the equipment automatically controlled by a program and meeting occupational safety and hygiene standards as prescribed by Vietnamese law.
Circular 08/2024/TT-BKHCN will take effect from December 23, 2024, opening up new opportunities and challenges in developing high-tech projects in high-tech zones in Vietnam, while improving the quality of research and production in this field.
